Terms of service
The terms that apply when you use the mintti point of sale, mintti AI, mintti modules and our website.
Last updated: 15 October 2026
1. About these terms
These terms are an agreement between you and [mintti legal entity name] ("mintti", "we", "us"). They apply to the mintti point of sale, mintti AI, mintti modules, our apps and our website (together, the "Service").
By creating an account or using the Service, you agree to these terms. If you use the Service for a business, you confirm you are authorised to accept these terms for that business, and "you" includes that business.
2. Your account
- You must give accurate information when you sign up and keep it up to date.
- You are responsible for your account, your staff accounts and everything done using them. Keep passwords and PINs secure, and set staff permissions that suit your business.
- Tell us straight away if you think your account has been accessed without permission.
- You must be at least 18 years old to create an account.
3. Plans, fees and payment
- Our plans, prices and what each one includes are shown on our pricing page or in your order. Prices are per location, per month, unless stated otherwise.
- The Starter plan is free for one location while you process payments through mintti Payments. If you stop using mintti Payments, we may move you to a paid plan after giving you notice.
- Paid plans are billed in advance and renew automatically each billing period until cancelled.
- Fees do not include taxes, which are added where required.
- Payment processing fees for mintti Payments are set out in your payment agreement and are separate from plan fees.
- We may change our prices by giving you at least 30 days' notice. The new price applies from your next billing period.
- Unless the law says otherwise, fees already paid are not refundable.
4. mintti AI
- mintti AI suggests actions based on your requests and your business data. Suggestions may sometimes be inaccurate or incomplete.
- Changes suggested by mintti AI are shown to you before they are applied. You are responsible for reviewing and approving them, and for decisions you make based on forecasts, insights or recommendations.
- Each plan includes a monthly allowance of AI requests. Unused requests do not carry over to the next month.
5. Acceptable use
You must not, and must not let anyone else:
- Use the Service for anything unlawful, fraudulent or harmful, or to process payments for prohibited goods or services.
- Try to access other customers' accounts or data, or get around security or usage limits.
- Copy, resell, reverse engineer or build a competing product from the Service, except where the law allows.
- Upload malware, or interfere with or overload the Service.
- Use the Service to send spam or to infringe anyone's rights.
We may suspend access if we reasonably believe these rules have been broken, and we will tell you why unless the law prevents us.
6. Your data
- You own the data you put into the Service, including menus, orders, customer details and reports ("Your Data").
- You give us permission to host, process and use Your Data only as needed to provide, secure and improve the Service, and as described in our Privacy policy.
- You are responsible for having the right to collect and use any personal information you put into the Service, including your customers' details.
- You can export Your Data while your account is active and for 30 days after it closes. After that, we may delete it.
7. Third-party services
The Service can connect to third-party services such as delivery platforms, payment networks and accounting software. Your use of those services is governed by their own terms. We are not responsible for third-party services, and they may change or stop working with mintti at any time.
8. Intellectual property
mintti owns the Service, including its software, design, branding and content, and all related intellectual property. We give you a limited, non-exclusive, non-transferable right to use the Service for your business while your account is active. If you send us feedback, we may use it without any obligation to you.
9. Availability and changes
We work to keep the Service available and to give advance notice of planned maintenance. The Service may occasionally be unavailable, and offline mode covers ordering and payments during internet outages, as described in our documentation.
We may add, change or remove features. If a change significantly reduces a feature you pay for, we will tell you in advance.
10. Disclaimers
To the extent the law allows, the Service is provided "as is" and "as available". We do not promise that the Service will be error-free or uninterrupted, or that forecasts and AI suggestions will be accurate. Nothing in these terms limits rights you have under consumer law that cannot be excluded.
11. Limitation of liability
To the extent the law allows, mintti is not liable for indirect or consequential loss, or for loss of profits, revenue, data or goodwill. Our total liability arising from these terms or the Service in any 12-month period is limited to the fees you paid us in that period, or US$100 if you used only free plans.
12. Indemnity
You agree to cover mintti's reasonable losses and costs arising from claims by third parties about Your Data, your use of the Service in breach of these terms, or your breach of the law.
13. Ending these terms
- You can cancel your plan at any time in your account settings. Cancellation takes effect at the end of the current billing period.
- We may end these terms or close your account with 30 days' notice, or straight away if you seriously breach these terms or fail to pay.
- Sections about fees owed, Your Data, intellectual property, disclaimers, liability and indemnity continue after these terms end.
14. Governing law
These terms are governed by the laws of [governing law jurisdiction]. Any dispute will be handled by the courts of that jurisdiction, unless the law gives you the right to bring it elsewhere.
15. Changes to these terms
We may update these terms from time to time. If a change is significant, we will give you at least 30 days' notice by email or in the Service. If you keep using the Service after the change takes effect, you accept the new terms.
